About this service

A Section 197 certificate tells your customers to deduct tax at a reduced rate, instead of you waiting a year for a refund.

Tax deducted at source is charged at a flat rate on your gross receipts. If your actual liability for the year is much lower, because your margins are thin, you have carried-forward losses or large deductions apply, the excess sits with the department until you file a return and claim it back.

Section 197 of the Income-tax Act, 1961 allows you to apply in Form 13 on the TRACES portal for a certificate directing named deductors to deduct at a lower rate, or not at all. The assessing officer decides the rate after reviewing your past returns, financials and projected income. It is a discretionary approval, not an entitlement.

Our in-house team builds the income and tax projection the application stands on, reconciles it with your last three years of returns and financials, lists each deductor with their TAN and expected payments, files Form 13, and follows up with the officer until the certificate is issued or the position is clear.
