Gift Deed / Will Drafting

A gift takes effect now; a will takes effect only after you are gone. Both are challenged most often for how they were drafted and executed, not for what they say.

About this service

Both documents pass property to someone you choose. They differ in when that happens, and in how easily it can be undone.

A gift deed transfers ownership during your lifetime, without consideration, under the Transfer of Property Act, 1882. Once it is executed, accepted by the donee and registered where immovable property is involved, it is generally irreversible. Stamp duty applies and varies by state, often at concessional rates for transfers between specified relatives.

A will takes effect only on death, can be revoked or rewritten any number of times, and attracts no stamp duty. It is governed mainly by the Indian Succession Act, 1925, with personal law applying to some communities. Registration is optional, but attestation by two witnesses who are not beneficiaries is essential.

We take instructions on the asset, the family position and what you are trying to achieve, then draft the document that fits, which is sometimes one and sometimes both. The drafting focuses on clear identification of assets and beneficiaries, a named executor where there is a will, and correct execution, because that is where challenges usually begin.
